Terms of Use

Module D.U.C.K. · Effective and last updated: 7 October 2026

These Terms of Use ("Terms") are an agreement between you and Nariman Mammadov (Məmmədov Nəriman Bəxtiyar oğlu), a sole trader registered with the State Tax Service of the Republic of Azerbaijan, taxpayer number (VÖEN) 1310036412 ("Module D.U.C.K.", "we", "us", "our"), covering the Module D.U.C.K. app and everything connected to it (the "Service").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

The short version

This summary is here to help you understand the Terms. It is not a replacement for them. The full text below is what applies.

Please read Sections 6, 7, 13, 14 and 15 in full. They cover alcohol risk, what Safe Mode does not do, and the limits on our legal responsibility to you.

1. Who we are

The Service is operated by Nariman Mammadov (Məmmədov Nəriman Bəxtiyar oğlu), a sole trader registered with the State Tax Service of the Republic of Azerbaijan, taxpayer number (VÖEN) 1310036412, General Akim Abbasov St. 16, apt. 58, Yasamal District, Baku AZ1141, Azerbaijan. You can reach us at ocag.bynm@gmail.com.

One legal operator, not a company. Module D.U.C.K. is run by a sole trader registered in Azerbaijan, so there is no limited company between you and the person who operates it, and the registered address is a residential one. A small team helps with operations and marketing and acts on the operator's behalf; the operator stays the one responsible to you.

By using the Service you confirm that you are able to enter into a binding agreement, and that you will follow these Terms and the law where you are.

The Service is currently provided free of charge. If we ever introduce paid features we will say so clearly before you are asked to pay for anything.

2. Eligibility and age

One rule, stated once. You may use Module D.U.C.K. only if you are old enough to legally drink alcohol where you live and where you are using the app. In the United States that means you must be 21 or older. Elsewhere it means you must meet your local legal drinking age. Under no circumstances may anyone under 18 use the Service, anywhere, for any reason.

To be completely clear, because an earlier version of our documents was not: there is no "18+" version of this rule. Eighteen is the absolute floor below which the Service is never permitted, not the standard. The standard is your local legal drinking age, and in the United States that age is 21.

When you sign up, or the first time you sign in with Google or Apple, you confirm that you meet this requirement for the country you live in, and we record when you did. We check age by asking you. We do not verify it against a document or an age-verification service. That does not make an untrue answer acceptable: if you tell us you are old enough when you are not, you are breaking these Terms, and we will close the account when we find out.

The Service exists to help adults record and understand their own drinking. Nothing in it is an offer, an inducement, or encouragement to drink, to drink more, or to drink unlawfully.

Do not create an account for anyone else, and do not let anyone who is not eligible use your account.

3. Your account, and your responsibility for it

4. Your licence to use the app

We give you a personal, limited, non-exclusive, non-transferable and revocable licence to install and use the app on a device you own or control, for your own personal, non-commercial use. That is all it is. We keep every other right.

You may not copy, modify, translate, reverse engineer, decompile, or take apart the app; rent, resell, or sublicence it; strip out or hide notices; scrape it; build a competing service from it; or use bots or scripts to create accounts or pull data out of it. Where the law of your country gives you a right that this paragraph tries to remove (for example a right to decompile for interoperability), the law wins.

5. Acceptable use and prohibited content

Module D.U.C.K. has a global public chat, plus comments, reactions, and posts that other people can see. Anything you write in the global chat can be read by every other user of the app, including strangers. Treat it that way.

Do not post, send, or upload anything that:

You also agree not to interfere with the Service: no attempting to reach other users' data, no probing or bypassing security or privacy controls, no overloading our servers, no malware, and no automated access we have not authorised.

Tagging a friend in a log, checking in at a venue, or sharing your location makes information visible to other people. Only do it when you have their agreement, and think about whether it is theirs to share. Someone else's drinking is their business, not content for you to publish.

6. Health and safety: read this

Module D.U.C.K. is not a medical device, and it does not give medical advice. Everything the app shows you about your drinking: units, standard drinks, calories, and any blood-alcohol (BAC) figure. All of it is a rough estimate produced by a formula, not a measurement of your body.

The estimate cannot know:

Because it is arithmetic on numbers you typed, the figure on your screen can be wrong by a wide margin, in either direction. It is not a test result and it is not a verdict on your body.

Never use this app to decide whether it is safe to drive, ride, cycle, operate machinery, swim, work, care for a child, or take medication. A low number on your screen is not permission to drive. The only safe amount of alcohol before driving is none. Breath and blood tests carried out by police measure your actual alcohol level; this app does not, and a screenshot of it is not a defence in any legal proceeding.
If you think someone may have alcohol poisoning, call emergency services immediately: 911 in the United States, 112 in the EU, 999 in the UK, 103 in Azerbaijan, or your local emergency number. Warning signs include confusion, vomiting while drowsy, seizures, slow or irregular breathing, pale or blue-tinged skin, low body temperature, and being unconscious or impossible to wake. Do not leave the person alone and do not wait to "sleep it off". Do not open this app instead of calling for help.

If you are worried about your drinking, or someone else's, please talk to a doctor or a local support service. A goal, a streak, or a sober day counter in this app is a tracking tool, not treatment, and it is not a substitute for professional care. We are not your healthcare provider, we do not diagnose or treat anything, and using the app creates no clinical relationship of any kind.

Drinking alcohol carries risks that are yours: to your health, your safety, your judgement, your job, and your legal position. To the extent the law allows, you accept those risks yourself. Decisions about whether, what, and how much to drink, and about what you do afterwards, are yours alone.

7. Safe Mode: what it is and what it is not

Safe Mode is a way to let someone you trust see where you are while you are out. Here is exactly how it works.

What it does

What it does not do

Safe Mode does not look after you. It does not monitor you. It does not detect that something has gone wrong. It does not notice a fall, an assault, a car crash, or that you have stopped moving. It never alerts anyone automatically, and it does not contact the police, an ambulance, a friend, or us on your behalf. Nobody is watching your dot. It is not a personal alarm, a panic button, an escort service, or a monitoring service.

Safe Mode is separate from the app's ordinary live-location sharing with accepted friends, which is approximate and which Ghost Mode turns off. The Privacy Policy explains all three location features in detail.

Do not use Safe Mode, live location, or any other feature to follow, monitor, or control another person. Sharing or tracking someone's location without their knowledge or consent is a serious misuse of the Service and, in many places, against the law. Accounts doing it will be terminated.

8. Your content

It stays yours. Your logs, photos, comments, chat messages, check-ins, and everything else you create in the app ("Your Content") belong to you. We do not claim ownership.

What you allow us to do. So that the app can actually work, you give us a worldwide, non-exclusive, royalty-free, sublicensable-only-to-our-hosting-providers licence to host, store, copy, back up, transmit, adapt technically (for example resizing an image), and display Your Content, only in order to run and support the Service, and only to the people you chose to show it to through your visibility settings. We do not use Your Content for advertising, we do not sell it, and we do not publish it outside the app. If you post in the global public chat or set a log to public, you are choosing to show that content to other users of the Service.

When it ends. This licence ends when you delete the content or your account, other than copies already lawfully saved or reshared by other users, ordinary backup copies that get overwritten in the normal course, and anything we must keep to comply with the law or to deal with a report of abuse.

What you promise us. That you have the right to post Your Content, that it does not break these Terms or any law, and that it does not infringe anyone's rights or privacy, including the privacy of anyone who appears in a photo you attach or is named in something you post. You are responsible for Your Content. We do not endorse it and we do not check it before it appears.

We may remove content and suspend accounts. See Section 9.

9. Moderation, reporting, and enforcement

The global chat is filtered automatically for certain words. That filter is crude and catches only a fraction of what is unacceptable. It is not moderation and it is not a promise that the chat is safe or clean.

We are not obliged to monitor content, but we may. We may remove or restrict any content, and warn, limit, suspend, or permanently terminate any account, when we reasonably believe these Terms have been broken, someone is at risk, or we face legal exposure. Where it is appropriate and lawful we will tell you why and give you a way to reply, but we may act immediately in serious cases, including anything involving a minor, a threat of violence, or a risk to someone's safety.

To report content, a user, or a safety concern, use the report option in the app or email ocag.bynm@gmail.com. Tell us the username and, if you can, when and where you saw it. We will review reports as promptly as we reasonably can. If you believe someone is in immediate danger, contact your local emergency services first. We are not an emergency service, we do not monitor reports around the clock, and we may not see your message quickly.

If you believe content on the Service infringes your copyright, send us the details at ocag.bynm@gmail.com and we will look into it and remove infringing material where appropriate.

10. Third-party services, maps, and links

The Service shows information from other companies and links out to their websites. Some examples: sign-in through Google or Apple, map tiles, venue data, and links to ticket sellers or venue pages.

11. Our intellectual property and your feedback

The app, its code, design, look, text, graphics, and the name "Module D.U.C.K." belong to us or our licensors and are protected by law. Section 4 is the only right you get; nothing here gives you a right to use our name or logo.

If you send us an idea, suggestion, or bug report, thank you, and you agree we may use it freely, for any purpose, without payment or obligation to you. Do not send us anything you consider confidential.

12. Privacy

Our Privacy Policy explains what we collect, why, who receives it, and the rights and controls you have, including Ghost Mode, per-post visibility, hiding posts from specific people, CSV export of your logs, and deleting your account. It forms part of your agreement with us.

13. Disclaimers

The service is provided "as is" and "as available". To the fullest extent permitted by law we make no warranties of any kind, express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

In plain terms: we cannot promise that the app will always be available, that it will be free of bugs or interruptions, that data will never be lost, that estimates, venue data, calories, costs, or locations will be accurate, or that other users will behave well. Keep your own copy of anything that matters to you: you can export your logs as a CSV file from the app.

Nothing the app displays is medical, health, legal, or safety advice, and no part of it should be treated as a professional opinion about you.

Some places do not allow these exclusions. If you are a consumer, you keep every right your local law gives you that cannot be waived, and nothing here takes it away.

14. Limitation of liability

To the fullest extent permitted by law, neither Nariman Mammadov (Məmmədov Nəriman Bəxtiyar oğlu), a sole trader registered with the State Tax Service of the Republic of Azerbaijan, taxpayer number (VÖEN) 1310036412 nor its owners, staff, or suppliers will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from or connected to the service.

To the fullest extent permitted by law, our total liability for all claims connected to the service will not exceed the greater of (a) what you paid us in the twelve months before the claim arose, or (b) one hundred US dollars (US$100).

This applies to, among other things: your own alcohol consumption and anything that follows from it; any reliance you place on a BAC or drink estimate; anything that happens during or because of a Safe Mode or live-location session, including a failure of the feature; what other users do, say, or share; and third-party services, venue data, or links.

What we do not limit. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including, in many places, liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for anything else the law protects. If a court finds part of this section unenforceable, the rest still applies.

15. Indemnity

If someone brings a claim against us because of something you did, you agree to cover us for it. Specifically, to the extent the law allows, you will defend and indemnify Nariman Mammadov (Məmmədov Nəriman Bəxtiyar oğlu), a sole trader registered with the State Tax Service of the Republic of Azerbaijan, taxpayer number (VÖEN) 1310036412 against claims, losses, damages, and reasonable legal costs arising from: your use of the Service; content you posted; your breach of these Terms or of any law; your infringement of someone else's rights; your drinking or what you did while drinking; and your sharing of another person's location or personal information.

We may take over the defence of any such claim, and you agree not to settle it in a way that binds us without our written consent. If you are a consumer, this section applies only to the extent your local law permits.

16. Governing law and disputes

Talk to us first. If something has gone wrong, email ocag.bynm@gmail.com and give us a fair chance to fix it. Most problems can be sorted out this way, and we would rather do that than argue.

Governing law and venue. These Terms are governed by the law of the Republic of Azerbaijan, and disputes will be heard in the courts of Baku, Azerbaijan. This does not take away any protection that the law of the place where you live gives you and that cannot be excluded by agreement, including any right you have there to bring a claim in your local courts.

If you are a consumer in the EU/EEA or the UK, you keep the right to bring proceedings in your country of residence under its law, whatever the paragraph above says. Consumers elsewhere keep any equivalent non-waivable rights.

17. Suspension, termination, and deleting your account

You can leave whenever you want. Delete your account in Profile → Settings → Delete Account, or simply stop using the app. Deleting the account erases your data as set out in the Privacy Policy. Export your logs to CSV first if you want to keep them. Deletion cannot be undone.

We can end your access if you break these Terms, if we are required to by law, if keeping your account would put someone at risk or expose us to liability, or if we discontinue the Service. Where we can, we will give you notice and a chance to respond; for serious breaches we may act at once and without warning.

When your access ends, the licence in Section 4 stops. Sections that should sensibly outlive the agreement do, including 6, 7, 8, 11, and 13 to 16.

18. Changes to the Service and to these Terms

We are actively developing this app, so features will change, and some may be removed. We may also change these Terms. When we do, we will update the "last updated" date at the top and, for changes that matter to you, the app will ask you to read and accept the new Terms before you can keep using it. If you do not want to accept them, you can delete your account instead.

19. Apple App Store terms

If you got the app from the Apple App Store, the following also apply and Apple requires them:
